1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Valay service ("Service"), operated by EVG Tech Pty Ltd ("EVG Tech", "we", "us"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. These Terms are governed by the laws of Australia. Valay is a trading name of EVG Tech Pty Ltd (ABN 44 699 750 108).
2. The Service
Valay is an AI "front office" for plumbing businesses. Depending on your plan, the Service includes a branded booking micro-site, a 24/7 web-chat booking agent, calendar integration, customer SMS reminders, message handling, a dashboard and reporting, and (on the Pro plan) an AI voice agent on a dedicated phone number. Features vary by plan and may change over time.
3. Eligibility & accounts
To use the Service you must be at least 18 years old, operate a legitimate plumbing business in Australia, and provide accurate registration details. You are responsible for keeping your account credentials secure and for activity under your account.
4. Fees
The Service is offered on monthly or annual subscription plans, plus a one-off setup fee, in Australian dollars and exclusive of GST unless stated otherwise. Current pricing is shown on our website and may be updated from time to time. Applicable taxes may be added.
5. Acceptable use
You agree not to misuse the Service, including by using it unlawfully, infringing others' rights, attempting to disrupt or gain unauthorised access to our systems, or sending unlawful or misleading communications to your customers through the Service.
6. Availability & changes
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features with reasonable notice where practicable.
7. Liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, EVG Tech is not liable for indirect or consequential loss, and our total liability arising from the Service is limited to the fees you paid in the three months before the event giving rise to the claim.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where required by law. On termination, your right to use the Service ends.
